"BEST OF THE NEXT IN HORROR” CONTEST OFFICIAL RULES
Boost Horror Competition Submission Form
NO PURCHASE NECESSARY. Subject to Official Rules. Open to legal residents of the 50 United States and DC, age 18 or older. Void in PR and where prohibited.
1. CONTEST DESCRIPTION: The Boost Mobile “Best of the Next in Horror” Contest (the “Contest”) provides entrants with the opportunity to submit a one-page film treatment describing a new, original “Villain of Horror” character, (each a “Treatment”) as described in Section 5. The entrants who submit the five winning treatments will each receive a $10,000 award to produce a short film of no more than five minutes in length which incorporates the “Villain of Horror”, (each a “Short Film”) as described in Section 8 below. The entrant who submits the winning film will receive an additional $10,000 award, as described in Section 9 below. Note: Short Films entered into the Contest will not be entered into the Screamfest Horror Film Festival.
2. ELIGIBILITY: The Contest is open only to any individual who is 18 years of age or older at the date of entry and a legal resident of (and residing at the time of entry in) one of the 50 United States or the District of Columbia. Employees, officers, directors and agents of Boost Mobile (“Sponsor”), the Screamfest Horror Film Festival, their parent, affiliate, and subsidiary companies, their advertising and promotion agencies, and other companies associated with the promotion and operation of the Contest, (collectively, the “Contest Parties”) as well as the immediate family (spouse, parents, siblings, and children) and household members of each such person are not eligible. The Contest is subject to federal, state, and local laws and regulations and is void where prohibited by law.
3. AGREEMENT TO OFFICIAL RULES: Participation in the Contest constitutes entrant’s full and unconditional agreement to and acceptance of these Official Rules and the decisions of the Sponsor and judges, which are final and binding. Winning a prize is contingent upon fulfilling all requirements set forth herein.
4. ENTRY PERIOD: The Contest begins at 9:00 a.m. Eastern Time (“ET”) on 5/20/2008 and ends at 5:00 p.m. ET on 6/27/2008 (the “Entry Period”). Entries submitted prior to or after the Entry Period will be disqualified.
5. HOW TO ENTER: During the Entry Period, visit www.boostmobile.com/rules/horror (the “Website”), read all entry instructions, download and print the official Competition Submission/Release form, and create a one-page film treatment describing a new, original “Villain of Horror” character. Refer to Section 11 below for more details regarding the requirements for your entry, and to Section 6 below for details on the finalist judging criteria. Assemble the following items:
1. Your completed and signed official Competition Submission/Release form;
2. Your one-page film treatment describing a new, original “Villain of Horror” character;
3. A brief written description of your qualifications as a filmmaker and prior film work; and
4. One example of your prior film work on DVD.

Submissions must be received no later than 5:00 p.m. ET on 6/27/2008. You may enter as often as you wish, but each Treatment must be different and must meet all entry criteria. The same Treatment may only be entered in the Contest once. Subsequent and duplicate Treatments will be void. Entries that do not include all required information and do not adhere to the foregoing and following requirements will be considered void and will not be considered in the judging of this Contest. Note: by submitting an example of your prior work, you are not granting any rights to Sponsor for such prior work.
6. SELECTION OF POTENTIAL FINALISTS: On or before 7/7/2008, all eligible Treatments will be judged by Sponsor using the following criteria: (a) Creativity/Originality (40%), (b) Horror/Fright Factor (40%), and (c) Entrant’s Prior Work and Experience (20%). In the event of a tie, the tie will be broken based on the highest Creativity/Originality score. The judges’ decisions are final and binding. The entrants who submitted the five highest scoring entries will be deemed Finalists, pending verification of eligibility and continued compliance with these Official Rules. Sponsor reserves the right in its sole discretion to designate fewer than five Finalists it determines there are fewer than five entries of sufficient quality to designate as Finalists. The decisions of the judges are final. The odds of being selected as a Finalist depend on the skill and prior work of the entrants.
7. FINALIST PRIZES AND TERMS: Five (5) Finalist Prizes will be made available, each consisting of a $10,000 creative award, subject to Finalist’s agreement to produce a Short Film based on his/her finalist Treatment, and subject to Finalist’s continued compliance with these Official Rules and the instructions of Sponsor. Potential finalists will be notified by mail, telephone, email, or express mail, at Sponsor’s sole discretion. Finalist Prizes will be awarded in the form of checks made payable to each finalist. The first half of each Finalist Prize will be awarded upon the finalist’s timely return of a notarized Affidavit of Eligibility, a Liability Release, a Competition Agreement form, a Publicity Release (where lawful), and any other documentation or releases required by Sponsor. Such documentation and releases must be returned by the date specified in Finalist’s notification letter, or Finalist Prize will be forfeited and awarded to the entrant who submitted the next highest scoring Treatment, pending verification of eligibility. The second half of each Finalist Prize will be awarded upon a Finalist’s submission of (and Sponsor’s approval of) a complete script for his/her Short Film, as described in Section 8 below. Limit one Finalist Prize per entrant.
8. SCRIPTS/SHORT FILMS: Upon verification, each Finalist will be required to submit a complete script for his/her Short Film, based on his/her Finalist Treatment (each, a “Script”). Scripts must be bound with industry standard brads and formatted correctly. Scripts should include a synopsis bound with script after title page. Scripts must be received no later than 8/1/2008 at 5:00 p.m. ET at the address listed in Finalist’s congratulatory letter. Upon successful submission of their Scripts, Finalists will be required to create a short film of no more than five (5) minutes in length, based on the approved script submitted. Short Films must be submitted in the form of a DVD screening copy and one of the following: 35mm, 16mm, Beta, or DigiBeta, and must be received no later than 10/1/2008 at 5:00 p.m. ET at the address listed in Finalist’s congratulatory letter. Short Films must be accompanied by a fully-executed release in a form and manner acceptable to Sponsor for each (i) person other than you who appears in the Short Film and/or (ii) owner of any third party element not appearing in the Short Film and not owned by the Finalist. Failure to return any of these documents within the time period specified by Sponsor in its correspondence, the return of any notification as undeliverable, or your noncompliance with these Official Rules will result in the disqualification of your Entry. Further, Sponsor reserves the right to require a production schedule from Finalists and ongoing proof of compliance with such schedule.
9. SELECTION OF POTENTIAL GRAND PRIZE WINNER: On or before 10/15/2008, an independent panel of industry professionals (selected by Sponsor in its sole discretion) will judge the Finalists’ Short Films using the following criteria: (a) Creativity/Originality (30%), (b) Horror/Fright Factor (30%), and (c) Production Quality (40%). In the event of a tie, the tie will be broken based on the highest Creativity/Originality score. The judges’ decisions are final and binding. The Finalist who submits the highest scoring Short Film will be deemed the Grand Prize winner, pending his/her continued compliance with these Official Rules. The decisions of the judges are final. One (1) Grand Prize will be made available, consisting of $10,000 to be awarded to the winner in the form of a check. The odds of being selected as a Grand Prize winner depend on the skill of the Finalists.
10. FOR ALL PRIZES: Prizes are not transferable and must be accepted as awarded. No other substitutions may be made, except by the Sponsor, who reserves the right to substitute a prize with another prize of equal or greater value if the prize is not available for any reason as determined by the Sponsor in its sole discretion. Winners are solely responsible for all applicable federal, state, and local taxes and for any expenses, costs or fees associated with acceptance and/or use of prizes not specified herein as being included.
11. REQUIREMENTS FOR ENTRIES: Treatments, Scripts, and/or Short Films (“Entries”) must be created in English. Entries must not contain, as determined by Sponsor and judges, in their sole and absolute discretion, any content that:
1. contains sexually explicit, racially disparaging, libelous or other inappropriate material;
2. disparages, defames, misrepresents or is libelous to other people or companies (including, without limitation, Boost Mobile) or endorse any form of hate or hate group;
3. contains trademarks, logos, or trade dress (such as distinctive packaging) owned by others without their permission; or any commercial content that promotes any product or service;
4. contains copyrighted materials owned by others (including photographs, sculptures, paintings, and other works of art or images published on or in websites, television, movies, music or other media) without their permission (If you have any questions as to whether a particular work is in the public domain, please consult an attorney or omit the work);
5. contains materials embodying the names, likenesses, voices, or other indicia identifying any person, including, without limitation, celebrities and/or other public or private figures, living or dead without their permission (See Section 13-f below for permission requirements); or
6. violates any law or regulation.
Sponsor and judges reserve the right to reject and disqualify any Entry, in their sole and absolute discretion that they determine contains prohibited content or that they determine is offensive or otherwise inappropriate.
12. DISCHARGE/PAYMENT OF OBLIGATIONS: By submitting an Entry, you represent and warrant that you have discharged or paid (or will discharge or pay) all of the following: (i) Copyright: All claims and rights of the copyright holders, if any, in literary, dramatic, musical or other material, including stories, plays, scripts, scenarios, themes, incidents, plots, photos, clips, characteristics, dialogue, music, words appearing, used or recorded in your Entry; (ii) Contracts: All obligations, of any kind, including, without limitation, those with artists and personnel, relating to purchases, licenses, laboratory contracts, distribution, exhibition, performance or use of your Entry; and (iii) Guild/Union/Performing Rights Society/Participation Payments: Any payments required to be made by any performing rights society or to any body or group representing authors, composers, musicians, artists, and other participants in the production of your Entry, publishers or other persons having legal or contractual rights of any kind to participate in the receipts of your Entry or to payments of any kind as a result of the distribution or exhibition of your Entry and any taxes thereon or on the payment thereof.
13. ENTRANT’S REPRESENTATIONS: You warrant and represent that (a) you are the sole and exclusive owner of the Entry and all rights therein; (b) you have the full and exclusive right, power and authority to submit the Entry and to grant us the rights to the Entry herein granted upon the terms and conditions set forth herein; (c) no part of the Entry has been previously published in any medium or entered in any other contest or competition; (d) no rights in the Entry have been previously granted to any person, firm, corporation or other entity or otherwise exercised or made use of or encumbered in any way; (e) your Entry does not defame or invade publicity rights or privacy of any person, living or deceased, or otherwise infringe upon any person's personal or property rights or any other third party rights; and (f) if any Entry contains the likeness of any persons other than yourself or third party elements not owned by you, that you have obtained express written consent to submit such Entry and, if requested to do so, can produce such written consent in a form and manner acceptable to Sponsor. You further warrant and represent that there will be no persons under the age of 18 rendering services or granting rights in connection with your Entry. Sponsor's determination as to whether the Entry potentially violates the rights of any third party is final.
14. INDEMNITY: You agree to indemnify and hold the Contest Parties harmless from any and all claims, damages, expenses, costs (including reasonable attorneys' fees) and liabilities (including settlements), brought or asserted by any third party against any of the Contest Parties due to or arising out of your Entry, or your conduct in creating a Entry or otherwise in connection with this Contest, including but not limited to: claims for trademark infringement; copyright infringement; violation of an individual’s right of publicity or right of privacy; or defamation. By submitting an Entry, you further agree not to instigate, support, maintain, or authorize any action, claim, or lawsuit against the Sponsor, or any other person, on the grounds that any use of the Entry, or any derivative works, infringe any of your rights, including, without limitation, copyrights, moral rights. You acknowledge and agree that you do not have and shall not acquire directly or indirectly through your participation to this Contest by any means and in any manner any rights including any property rights or intellectual property rights with respect to Sponsor.
15. GRANT OF RIGHTS TO SPONSOR: By submitting an Entry, you grant the Sponsor and its designees a non-exclusive, worldwide, perpetual, royalty-free, sub-licensable right to make use of the Entry and any person's property (physical and personal and indicia) contained therein, in any media now or hereafter known, without any payment or other consideration of any kind, or permission or notification, to you or any third party. Sponsor reserves all rights, on a non-exclusive basis, including without limitation, the right to reproduce, record, alter, amend, edit, publish, create derivative works from, publicly perform, use, store, broadcast and stream the Entry in connection with any and all media now or hereafter known throughout the world, in any and all media, now or hereafter known, in perpetuity, without additional review, compensation, or approval from you or any other party. Without limiting the foregoing, Sponsor shall have the right to use the Entry in any merchandising, advertising, marketing, promotion or for any other commercial or non-commercial purpose, including, without limitation, the promotion and/or marketing of Sponsor’s goods and services. You forever waive and relinquish all so-called "moral rights” (droit moral) now or hereafter recognized. Nothing herein shall constitute an employment, joint venture, or partnership relationship between you and the Sponsor. In no way are you to be construed as the agent or to be acting as the agent of the Sponsor. You further acknowledge that the Sponsor is in no way obligated to broadcast, publish or use your Entry in any way.
16. GENERAL CONDITIONS: Each entrant agrees to return upon request the full value of any prize award if he/she fails to deliver any required Treatment, Script, Short Film, or documentation in a form acceptable to Sponsor and by any applicable deadline. Entries and other submitted material become the property of Sponsor and will not be acknowledged or returned. In the event that any entrant is age 18 or older (as is required for entry) but has not yet reached the age of majority in his/her state of residence, such entrant’s parent or legal guardian agrees to all conditions of these Official Rules on behalf of such entrant, and further agrees to co-sign any required documents if such entrant is chosen as a potential winner. In the event that the operation, security, or administration of the Contest is impaired in any way for any reason, including, but not limited to fraud, virus, or other technical problem, the Sponsor may, in its sole discretion, either: (a) suspend the Contest to address the impairment and then resume the Contest in a manner that best conforms to the spirit of these Official Rules; (b) award prizes according to the applicable judging criteria from among the eligible entries received up to the time of the impairment; or (c) to proceed in such a manner as may be deemed fair and equitable by Sponsor in its sole discretion. The Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. The Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
17. RELEASE AND LIMITATIONS OF LIABILITY: By participating in the Contest, entrants agree to release and hold harmless the Contest Parties and their respective officers, directors, employees, and agents (the “Released Parties”) from and against any claim or cause of action arising out of participation in the Contest or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Contest; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing errors or any errors made in the advertisement of the Contest; (d) lost, late, postage-due, misdirected, or undeliverable mail; (e) errors in the administration of the Contest or the processing of entries; or (f) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest or receipt of any prize. Entrant further agrees that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the Contest, and in no event shall the Released Parties be liable for attorney’s fees. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.
18. PUBLICITY: By submitting an Entry, you grant to Sponsor and its affiliated companies the right, except where prohibited by law, to use your name, likeness, picture, address (city and state), voice, biographical information, Entry and written or oral statements, for advertising and promotional purposes in promoting or publicizing Sponsor, its affiliated companies, and the products or services of each, in any and all media without limitation as to time or territory, without compensation unless required by law. You shall have no right of approval, no claim to compensation, and no claim (including, without limitation, claims based on invasion of privacy, defamation, or right of publicity) arising out of any use, blurring, alteration, or use in composite form of your name, picture, likeness, address (city and state), biographical information, or Entry.
19. PRIVACY: Information submitted in connection with the Contest will be treated in accordance with these Official Rules and Sponsor’s Privacy Policy (as may be amended from time to time), currently located at http://support.boostmobile.com/service_policies/privacy_policy.html; provided, that in the event of any conflict between these Official Rules and such Privacy Policy, the terms and conditions of these Official Rules shall prevail.
20. DISPUTES: Except where prohibited, entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of California. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of California, without giving effect to any choice of law or conflict of law rules (whether of the State of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of California.
